Do you need an immigration lawyer in Bulgaria after a refusal?
It depends on what you want to do with the refusal. If you want to challenge the decision itself before a court, that is work for a licensed Bulgarian advocate. If you want to apply again with a better file, most of the work is documents: what was missing, what was translated wrongly, which condition was not proven.
The refusal decision is the starting point either way. Read it for two things: the legal ground it cites and how it can be challenged. We do not quote an appeal deadline on this page — it is not in our reference data, and the decision you received is the document that counts.
Where is the queue, and what can be sped up?
A Bulgarian permit is a chain of authorities, and each link has its own timing. For the single permit the employer applies first, then comes the type D visa, then the Migration Directorate issues the permit, valid for 3 years16. No authority publishes a total for that chain — see work permit processing time.
Some limits are fixed. The EU Blue Card: 3 months7 at most. Investor residence: Investment Agency pre-approval within 40 days8, before the residence procedure starts. An EU long-term residence application must be decided within 6 months5 under the EU directive.
- Cannot be sped up: the authority’s own review time, and the waiting that starts again with a new application.
- Can be shortened: time spent collecting apostilles and certified translations abroad, and rounds of “please add document X”.
- Can be avoided entirely: a second refusal on the same ground, if the ground was paperwork.
Example: a digital nomad refused on income
Most second refusals repeat the first one: the same missing proof, filed faster.
The digital nomad permit (Foreigners Act Art. 24s) requires annual income of at least 50 national minimum monthly wages. With the minimum wage at €620/month9, that is €31,010/year39 a year. The threshold moves with the minimum wage, so a file prepared last year against an older figure can fall short without anything changing in the applicant’s income.
Before reapplying we recalculate the income against the current threshold, check that bank statements and contracts show the same amounts in the same currency, and have every foreign document translated by a certified translator. If the income genuinely does not reach the threshold, reapplying on this route will not help — and we say so before you pay.
Is another route faster than reapplying?
Sometimes. A highly qualified worker refused a single permit may fit the EU Blue Card, which has a statutory maximum and a salary condition of 1.5 x average gross monthly salary in Bulgaria27. An investor may look at residence by investment from €511,29218 (BGN 1,000,000 at the fixed rate 1.95583) in qualifying instruments.
One route does not exist any more: citizenship by investment was repealed in 2022 (Act amending the Bulgarian Citizenship Act (State Gazette No. 26/2022): Art. 12a and 14a (citizenship after investment) repealed410).
